These terms cover your use of the Ascendra Media website (the "Site") and the services we offer. By using the Site or working with us, you agree to them. If you don't agree, please don't use the Site.

Who we are

Ascendra Media ("Ascendra", "we", "us") is a marketing agency serving restaurants and product-based businesses. You can reach us through the forms on this Site.

Using the Site

You may use the Site to learn about our services and to get in touch with us. You agree not to misuse it: no scraping, no automated submissions, no attempts to interfere with the Site or the systems behind it, and no submitting information that is false, misleading, or that you don't have the right to share.

Inquiry forms

Submitting a form is a request for a conversation, not a contract. It doesn't obligate us to take you on as a client, and it doesn't obligate you to hire us. We'll review what you send and reach out to book a call. Any actual engagement is governed by a separate written agreement that spells out scope, pricing, timelines and terms.

Our services

Descriptions of services on the Site (social media posting, Meta ads, creator and influencer partnerships, website design) are general. What we deliver for you is defined in your service agreement. Marketing outcomes depend on many things outside our control, including platform changes, competition, seasonality and your own business operations, so we don't guarantee specific results such as follower counts, rankings, sales or revenue.

Third-party platforms

Our work runs on platforms we don't control, including Meta (Facebook and Instagram), TikTok, Google and others. Your use of those platforms is subject to their own terms. We're not responsible for their outages, policy changes, account actions or fee changes.

Content and intellectual property

Everything on the Site, including text, design, graphics and the Ascendra Media name and logo, belongs to us or our licensors. You may not copy or reuse it without written permission. Ownership of content we create for clients is set out in each client's service agreement.

Links to other sites

The Site may link to other websites. We don't control them and aren't responsible for their content or practices.

Disclaimer

The Site is provided "as is". We work to keep it accurate and available but don't promise it will be error-free or uninterrupted. Nothing on the Site is legal, financial or professional advice.

Limitation of liability

To the fullest extent allowed by law, Ascendra Media isn't liable for indirect, incidental or consequential damages arising from your use of the Site. Liability connected to any services we provide is governed by the applicable service agreement.

Changes

We may update these terms from time to time. The date at the top tells you when they last changed. Continuing to use the Site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of New York and the United States, without regard to conflict-of-law rules.
